What Is An Order of Protection, And How Do You Get One?
An order of protection is a legal remedy provided under the Illinois Domestic Violence Act that, once issued, legally prohibits your abuser from interacting with you by any means. Orders of protection can be granted on a temporary and emergency basis until a “plenary” or evidentiary hearing can be held. During that plenary hearing, you could be given protection for up to two years.
To qualify for an order of protection, you (the “petitioner”) must prove that abuse has already occurred, the threat of future abuse is likely and that your abuser (the “respondent”) is a current or former spouse, current or former dating partner, family member, co-habitant or co-parent.
Your petition for an order of protection can be created and filed online. It can also be filed in the courthouse of the county where you reside, your abuser resides, or where the abuse took place. If you’re in imminent danger, you will receive an immediate hearing where a judge may issue an emergency order of protection. If that occurs, your abuser will be served the petition and order that details what they are prohibited from doing.
An evidentiary or “plenary” hearing follows within 21 days of filing, during which both parties present evidence. If your order is granted, your remedies can include:
- Exclusive possession of your residence
- Requiring your abuser to undergo counseling and rehabilitation
- “Stay-away” orders in which your abuser is forbidden to visit specified locations, such as your school or workplace
- Temporary care and custody of children granted to you with limited or no visitation for the respondent
